Thank you for visiting our website, www.learnbanking.in ("Website"), www.dkprlms.learnbanking.in or downloading our mobile application "Learnbanking LMS" ("App"). The Website and the App referred to herein as "Platforms".
For the purposes of these Terms of Use, the term 'learnbanking' or 'Us' or 'We' refers to dkpr e-Learn Private Limited. The term 'You' and 'learner' refers to the user or visitor of the Website and/or App.

This is a contract with dkpr e-Learn Private Limited, trading as learnbanking, whose registered office is at Z6-601, Roseland Residency, Pimple Saudagar,Pune, Maharashtra (India) henceforth referred to as "learnbanking". Please carefully read the following terms before accessing this site or using a course. By accessing the site (which includes, visiting, registering, purchasing or accessing a course) you accept and agree to all of the covenants and conditions imposed in this agreement. If you do not agree to these terms, you may not access the site.

By using this service, you agree that you have read, understand and agree to these terms. You also agree to review this agreement periodically to be aware of modifications to the agreement, which modifications learnbanking may make at any time. Your continued use of this site will be deemed your conclusive acceptance of any modified agreement.

1) General
1.1) These Terms of Use sets forth legally binding terms for Your use of our Platforms and services. By using the Platforms, You agree to be bound by these Terms of Use, whether You are a “Visitor” (which means that you simply browse our Platforms) or you are a “Subscriber” (which means you have registered with learnbanking as a user). If You do not accept these terms, You should leave the Website and/or App and discontinue the use of the service immediately.
1.2) We may modify these Terms of Use from time to time, and such modification shall be effective upon its posting on our Platforms. You agree to be bound by any modification to these terms when You use the Platforms after any such modification is posted; it is therefore important that You review these Terms regularly.
1.3) learnbanking reserve the right to change the content used at any time.
1.4) Learners who fail to complete the e-learning course in the time available will not be eligible for a refund.
1.5) Learners may receive an electronic notification 1 month prior to the course end date.
1.6) All rights not expressly granted herein are reserved.
1.7) These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
1.8) If you do not agree with these Terms and Conditions you must cease the course immediately and notify learnbanking of your intent not to continue

2) General Registration Requirements

2.1 In consideration of your use of our Platforms, you represent that You are of legal age to form a binding contract and are not a person barred from receiving services under any law in force in India or other applicable jurisdiction. You also agree to:
(a) provide true, accurate, current and complete information about yourself while registering on our Platforms to avail the Services; and
(b) maintain and promptly update Your registration data to keep it true, accurate, current and complete.
2.2 If You provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We reserve the right to suspend or terminate Your account and refuse any and all current or future use of our Platforms (or any portion thereof) at any time.
2.4 You may access our Platforms as available for Your information and personal use.
2.5 You may be required to enter a valid phone number while registering on our Platforms as a subscriber. By registering Your phone number with us, you consent to be contacted by us via phone calls, SMS notifications or instant messages, in case of any subscription/service updates. If we do so, each communication we send You will contain instructions permitting you to "opt-out" of receiving future communications. In addition, if at any time You wish not to receive any future communications or You wish to have Your name deleted from our mailing lists, please contact us as indicated below. If You are registered with the DND National registry, You may not receive any promotional messages from Us.

3) Learners Account and Security

If You register with learnbanking, you may be required to complete a verification process as part of setting up Your account. Once set up, You are responsible for maintaining the confidentiality of Your account information, and are fully responsible for all activities that occur through Your account. Should there be instances of any unauthorized use of Your account or any other breach of security, please notify Us to stop processing requests from Your account, until further instructions.

4) Financial


4.1) Online payment is the preferred method of payment.
4.2) Course fees include the licensing of training materials to a limited period of time to and appropriately qualified course content. Each license is valid to one person only and cannot be exchanged or shared.
4.3) learnbanking reserve the right to review the pricing and take appropriate action when changes to course or exam specification occur beyond our control.

5) e-Learning Materials

5.1) The e-learning couese material is property of learnbanking.
5.2) This e-learning couese material has been prepared, maintained, updated and distributed by learnbanking
5.3) The use of the e-learning couese material on our courses is restricted to the Registered User who has been supplied with the log in details by learnbanking.
5.4) The Registered User shall not copy, share, modify, transmit, distribute, or in any way, exploit the copyrighted materials provided by learnbanking other than for their own individual training. Use for any other purpose is expressly prohibited by law and any violators will be prosecuted.
5.5) The Registered User shall not permit anyone else to copy, use, modify, transmit, distribute, or in any way, exploit the copyrighted materials.
5.6) The materials made available by learnbanking are provided "as-is" without warranties of any kind, either expressed, or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title or non-infringement.
5.7) learnbanking does not warrant that the materials will be error free including technical inaccuracies, nor free of viruses, or other harmful matter. The entire cost of any necessary service, repair, or correction, is the Registered User's responsibility.
5.8) learnbanking may make improvements, or changes, to this material at any time without prior notification.
5.9) All rights not expressly granted herein are reserved.
5.10) These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
5.11) If you do not agree with these Terms and Conditions you must cease to use the e-learning immediately.

 

6) Access to the courses

6.1) learnbanking strives to provide the course content to its learners on a continuous basis. To that end, learnbanking will take all commercially reasonable efforts to provide uninterrupted Access of the courses to its learners. However, from time to time, learners may be unable to Access the courses due to conditions beyond learnbanking's control. Such conditions include, but are not limited to: force majeure, acts of God, power outages, and the acts of computer hackers and others acting outside the law. Also, from time to time, Access may be unavailable due to software issues, server downtime, increased Internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of the courses to its learners, learnbanking will take all commercially reasonable steps to ensure Access is restored within a reasonable period of time. The term "commercially reasonable," as used in these Terms, shall mean reasonable efforts taken in good faith without an unduly or burdensome use or expenditure of time, resources, personnel or money.
6.2) learnbanking endeavours to provide the highest quality content to its learners. To that end, learnbanking reserves the right, in its sole discretion, to change, modify, or discontinue any aspect or feature of this Site in whole or in part, including, without limitation, the content, availability, Access and/or the Terms of this Site. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this Site.
6.3) Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment and Internet service necessary for use of the Site.

7) Prohibited Conduct

7.1 You agree not to use the Platforms inappropriately, or otherwise transmit information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content" means the transmission of information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials generated by a user) that:
is patently offensive and/or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual

contains nudity, violence, pornography, sexually explicit material or offensive subject matter
provides any telephone numbers, street addresses, last names or email addresses of anyone other than your own

violates any intellectual property or other proprietary right of any third party, including Content that promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files
involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”
contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page)
furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses
solicits passwords or personal identifying information from other Subscribers
involves commercial activities and/or sales without learnbanking’s prior written consent, such as contests, sweepstakes, barter, advertising, and/or pyramid schemes
includes a photograph of another person that you have posted without that person’s consent or otherwise constitutes an invasion of an individual’s privacy or infringement of publicity rights
denigrates, ridicules, or demeans another person; or contains a virus or other harmful component.
7.2 You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses our Platforms.

8) Third Party Content; Hyperlinks

8.1) learnbanking.in makes no warranty, either expressed or implied, of the accuracy, merchantability, fitness for a particular purpose, or non-infringement of the information provided by third parties. This includes, but is not limited to, any information found on a link located on this site that allows users to access information found on another site. Additionally, learnbanking.in does not warrant the existence or functionality of any website which can be accessed through a link located on this site.
8.2) Copyrights, Trademarks and Other Proprietary Rights.
8.3) learnbanking or its third party content providers shall retain all worldwide rights in the intellectual property in and on the Site, including, but not limited to, trademarks, service marks, trade dress, inventions, ideas, trade secrets, the source code, the HTML code, the "look and feel" of the Site, its colour combinations, layout, and all other graphical elements, and the copyrights in and to its original content. You should assume that everything you read or see on the Site is copyrighted, trademarked, or otherwise protected and owned or licensed by learnbanking.

9) Disclaimers and Limitation of Liability

9.1) Users access this site at his/her/its own risk. The site is provided on an "as is, as available" basis without warranty of any kind, expressed, implied or statutory, and any and all warranties of merchantability, fitness for a particular purpose or non-infringement of third parties' rights are specifically disclaimed. learnbanking does not warrant any particular result from use of the software or site. learnbanking does not warrant that the information on the site is accurate, complete or complies with any particular law or regulation, or that the operation of and your access to the site will be uninterrupted, error-free, virus-free or completely secure.
9.2) Under no circumstances and under no legal theory (tort, contract or otherwise) shall learnbanking or any of its affiliates, agents, employees, shareholders, directors, officers, third party content providers, successors or assigns be liable to you or any other person or entity for any indirect, special, incidental, punitive or consequential damages of any character, including without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, loss of data, loss of productivity or contract, or any and all other commercial damages or losses.
9.3) Your use of this site is at your sole risk and any content that you download is downloaded at your own discretion and risk, and you are solely responsible for any damage to your computer system in excess of the amount learnbanking received from learners for a course, and for any loss of data that results from the downloading of any such content, including any damages resulting from computer viruses.
9.4) In no event will learnbanking be liable for any damages in excess of the amount learnbanking received from the learner for access to a course, even if learnbanking have been informed of the possibility of such damages, or for any claim by any other party.
9.5) In no event will warranties provided by law, if any, apply unless they are required to apply by statute notwithstanding their exclusion by contract.
9.6) This disclaimer is applicable to any damage or injury resulting from the negligence or an omission of learnbanking, computer virus or other similar item, telecommunications errors, or unauthorized access to or use of user information through theft or any other means. learnbanking is not liable for criminal, tortious, or negligent actions or omissions of third parties that affect this site.

10) Termination or Suspension of Account or Services

You agree that learnbanking may at any time and for any reason, terminate your access to our Platforms, or restrict or suspend your access to all or any part of the Website or the App at any time, for any or no reason, with or without prior notice, and without liability. We may also terminate the rendering of any service without prior notice or liability.

11) Preservation/Disclosure

You acknowledge, consent and agree that learnbanking may access, preserve and disclose Your account information if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to:

11.1 comply with legal process nationally or internationally
11.2 enforce these Terms
11.3 respond to your requests for service or complete your tasks
11.4 protect the rights, property or personal safety of learnbanking, its subscribers and the public, or
11.5 pursuant to the terms of the Privacy Policy.

12) Proprietary Rights

All materials on our Platforms, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, “Material”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by learnbanking. You acknowledge and agree that all content on our Platforms is made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere in our Platforms, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without learnbanking’s prior express written permission. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize our Platforms or any part of the Material for any purpose other than its intended purposes is strictly prohibited.

13) Cancellation policy
13.1) User/ Learner may send a mail to admin@learnbanking.in for deregistration/ cancellation of the account.
13.2) If a learner cannot access the course online via www.dkprlms.learnbanking.in because they fail to meet the required system requirements given on the website, then learnbanking will not take responsibility or give a refund to the purchaser.
13.3) The start date of the course and access is deemed to be the date that the learner first has access to the self-study materials. learnbanking will make one attempt to warn the learner when this access/ membership period has ended. After this attempt learnbanking can no longer guarantee access to the course or that certification will be possible.

14) Refund Policy
No refund shall be made to learners on cancellation of the account at the request of the learners.
